DAVAO CITY, Philippines ––President Ferdinand R. Marcos Jr. announced on Friday that a new Executive Order (EO) will soon be issued to provide clearer guidelines on the functions, services, and facilities to be devolved to local governments.
President Marcos revealed that he plans to amend Executive Order No. 138, which was originally signed in 2021. “This year, we aim to issue an order amending Executive Order No. 138, s. 2021, with clearer parameters on what functions, services, and facilities will be devolved,” he stated during the second day of the Local Governance Summit in Pasay City.
The President highlighted the government’s ongoing efforts to ensure that devolution is both workable and equitable.
“We have been working on this for some time and believe we have found a formula to allocate funding appropriately. Some services will remain the responsibility of the national government, while others will be managed by local governments,” he said.
“This approach allows us to better address the needs of both the national and local governments. The Mandanas ruling aims to improve local governance, and our goal is to support this improvement effectively,” he added.
The Mandanas vs. Garcia ruling by the Supreme Court expanded the just share of Local Government Units (LGUs) from national taxes to include collections from the Bureau of Customs, in addition to the Bureau of Internal Revenue.
This significant increase in the tax base strengthens fiscal decentralization and the financial capacity of LGUs.
President Marcos expressed optimism that with the new parameters, LGUs will be better equipped to implement and localize the Sustainable Development Goals (SDGs).
The Local Governance Summit, held annually, updates local government units and stakeholders on the latest governance developments, shares best practices on digital transformation and climate resilience, and enhances capabilities for SDG implementation.
Discussions at the summit cover topics such as digital governance, smart infrastructure, urban design, climate resilience, environmental governance, and public health and safety.
